Today, 24 May 2021, the confirmation of charges hearing in the case The Prosecutor v. Ali Muhammad Ali Abd-Al-Rahman (“Ali Kushayb”) opened before Pre-Trial Chamber II of the International Criminal Court (ICC), composed of Judge Rosario Salvatore Aitala (Presiding judge), Judge Antoine Kesia-Mbe Mindua and Judge Tomoko Akane. The hearing is scheduled until 27 May 2021. The judges will hear successively the oral submissions of the Prosecutor, the Legal Representatives of the Victims and the Defense. The confirmation of charges hearing is not a trial. The purpose of the confirmation of charges hearing is for the judges to determine whether there is sufficient evidence to establish substantial grounds to believe that the person committed each of the crimes charged. If the charges are confirmed, in full or in part, the case will be transferred to a Trial Chamber, which will conduct the subsequent phase of the proceedings: the trial. In accordance with Regulation 53 of the Regulations of the Court, the Pre-Trial Chamber shall deliver its written decision within 60 days of the date on which the confirmation hearing ends. The Pre-Trial Chamber may then: confirm those charges for which the Chamber has determined that there is sufficient evidence, and commit the suspect to trial before a Trial Chamber; decline to confirm those charges for which it has determined that there is insufficient evidence and stop the proceedings against Mr Abd–Al-Rahman; adjourn the hearing and request the Prosecutor to provide further evidence, to conduct further investigations or to amend any charge for which the evidence submitted appears to establish t a crime other than the one charged was committed. Mr Abd-Al-Rahman was transferred to the ICC’s custody on 9 June 2020, after surrendering himself voluntarily in the Central African Republic. Ali Muhammad Ali Abd-Al-Rahman (“Ali Kushayb”)s’est ouverte devant la Chambre préliminaire II de la Cour pénale internationale (CPI), composée du juge Rosario Salvatore Aitala (juge président), du juge Antoine Kesia-Mbe Mindua et de la juge Tomoko Akane. L’audience est prévue jusqu’au 27 mai 2021. Les juges entendront successivement la présentation des observations orales du Procureur, des Représentants légaux des victimes et de la Défense. Une audience de confirmation des charges n’est pas un procès. L’audience de confirmation des charges sert aux juges à déterminer s’il y a des motifs substantiels de croire que le suspect a commis ces crimes. Si la Chambre préliminaire décide de confirmer les charges, en tout ou en partie, elle renverra l’affaire devant une Chambre de première instance, laquelle sera chargée de conduire la phase suivante de la procédure, à savoir le procès lui-même. En vertu de la Norme 53 du Règlement de la Cour, la Chambre préliminaire doit rendre sa décision par écrit dans un délai de 60 jours à compter de la fin de l’audience de confirmation des charges. A l’issue de ce délai, la Chambre préliminaire peut : confirmer les charges pour lesquelles elle a conclu qu’il y a des preuves suffisantes, auquel cas l’affaire est renvoyée en jugement devant une Chambre de première instance pour un procès ; refuser de confirmer les charges pour lesquelles elle a conclu qu’il n’y a pas de preuves suffisantes et ajourner les procédures à l’encontre de M. Abd–Al-Rahman ; ajourner l’audience et demander au Procureur d’apporter des éléments de preuve supplémentaires ou de procéder à de nouvelles enquêtes, ou de modifier toute charge pour laquelle les éléments de preuve produits semblent établir qu’un autre crime que celui qui est reproché a été commis.
